The Venue and the Society have agreed to trial the EVOSYNC™ Problem Gambling Register developed and owned by Blue Sync Limited.

The EVOSYNC™ Problem Gambling Register is a software tool designed to facilitate:

1. the issuing of self-exclusion orders under section 310 of the Gambling Act 2003 (‘Act’) and venue-initiated exclusion orders under sections 309 and 309A of the Act;
2. the processing of multi-venue exclusion orders by class 4 operators; and
3. the enforcement and monitoring of exclusion orders.

For the purposes of conducting the trial, the Venue Manager hereby gives Blue Sync Limited authority to act on his or her behalf to issue exclusion orders for the Venue, and to upload information to the EVOSYNC Problem Gambling Register™ regarding persons who are excluded from the Venue.

In using the EVOSYNC™ Problem Gambling Register, the Society, Venue Operator and Venue Manager agree to take all reasonable steps to ensure that all personal information relating to excluded persons is treated in accordance with the Privacy Act 1993 and is not displayed in public view.

The Society, Venue Operator and Venue Manager acknowledge that they use the EVOSYNC™ Problem Gambling Register and any accompanying hardware supplied by Blue Sync Limited at their own risk.

To the fullest extent permitted by law, Blue Sync Limited excludes liability for any loss or damage of any kind including but not limited to any lost revenue, profit, or data, and any indirect or consequential loss.

Notwithstanding the above, if for any reason, Blue Sync Limited and/or its officers, employees, contractors and/or agents are liable to any other party to this agreement in contract, tort or otherwise, the combined maximum liability of Blue Sync Limited and its officers, employees, contractors and agents to all parties in the aggregate shall be $100,000, irrespective of the number of events giving rise to the liability.

The Society, Venue Operator and Venue Manager agree to provide all reasonable assistance to any person conducting research or analysis into EVOSYNC™ with Blue Sync Limited’s permission, including (but not limited to):

1. completing written or electronic surveys and/or participating in Skype or face-to-face interviews upon request during the trial period or in the 6 week period following the end of the trial; and
2. taking all reasonable steps to ensure that Venue staff do the same.

Blue Sync Limited welcomes feedback on the EVOSYNC™ Problem Gambling Register. The Society, Venue Operator and the Venue Manager acknowledge that all the intellectual property in the EVOSYNC™ Problem Gambling Register belongs to Blue Sync Limited, including any changes made as a result of the feedback provided.

At the conclusion of the trial, the Society and/or the Venue may request a copy of any information uploaded to the EVOSYNC Problem Gambling Register™ regarding persons who are excluded from the Venue, including each person’s name, photo and the date of the exclusion expiry. Blue Sync Limited will duly provide such information without charge to enable the Society and/or the Venue to migrate to a new exclusion order management system or revert to a paper system.
